better business bureau anyone???

I wonder if you could take APS to the DA's office... I mean, if there's a warning/citation/then boot proceedure & clause in the contracts that they draw up... then they've obviously broken and defrauded all of their contracts and as such should be questioned as to their business practices.

If you can prove that there was malicious intent to immediately boot without question, thus breaking your own contract, then it's criminal, hence, the DA's office. The BBB would be like mayonnaise added to a tuna fish sandwich. You wanna go with criminal intent at all times because it could mean the scrotum bags at APS could face jail... but what's the relish?
a concerned citizen email/letter to all of the other ASSociations that are also party knowingly or otherwise to these people's tactics... hence losing contracts/income/business...
that could be relished.
the only problem with that scenario is the little worker bee that gets screwed in the deal but if they were party to it willingly then, more the better...

I'm not a lawyer or anything, but it looks like the contract states that the parking enforcement procedures are :
Issuance of warnings to advise vehicle driver/owner that a violation has occured for minor violations such as expired plates or not having a permit displayed.
Then it goes on to say that citations will be issued for repeat offender or more serious violations. STILL NO MENTION OF BOOTING.
The contract does not mention booting UNTIL "violation is not paid and/or corrected," "repated violations and for illegally parked vehicles in a reserved space, fire lane and/or handicapped space."
Now, unless the OP had citations that were unpaid (which from reading the thread he said he didn't have any), there's no reason the company should be booting ANY cars for simply not having the permit displayed once. They should've been issued a warning or a citation. If they've been doing this for a while now, maybe someone should be asking for money back. I certainly would.
The contract also states that this is a month-to-month contract and it can be terminated with a 30-day notice by either party.
EDIT: Edited to make more sense: Oh crap. At the end of the contract it says: Vehicles that are in violation of any of these guidelines are subject to being fined/immobilized and/or towed. They put it in bold too, so I guess the contract does give them the right to boot you for not having a sticker displayed, even though the language earlier in the contract says otherwise?

So I'm a little confused about this. How did the boots come off? Did APS take them off themselves, not being allowed to have their boots on a car in a garage?

UPDATE KIDDIES

Tomorrow, Thursday June 19th, 2008 SHASTA Pools will be notified of Breach of Contract. They HAVE NOT paid the fee and the company truck has been there many days with said boot. They are probably resisting, as it's current state for so long.
Updates concerning news networks will be updated.
Updates waiting for a response from HOA President concerning Breach of Contract E-mail I sent.
I'm still debating as to whether or not start- ISSUING COPIES WITH HIGHLIGHTED BREACH OF CONTRACT ON ALL SAID VICTIMS PHANTOMLY ON THEIR VEHICLES
Do remember, this is not really me vs the HOA, they appear to be on my side, well, kinda. It's really kinda a play on words, kinda sorta yes and no. APS is the main entente, so I kinda have to be little careful putting literature on every booted car. As you know it will REALLY REALLY BLOW UP. EVERY BOOTED OWNER will be sitting there with a copy of the rules in complete defiance of APS with everything in breach RIGHT INFRONT OF APS'S FACES! Then what happens, HOA finds out immediately, and they will know who, GUESS WHO??????????????????????????
So that's up in the air.
CAN YOU IMAGINE COMING OUT TO PAY $140 FOR THIS? I'M SURE SHASTA POOLS IS IRKED! GEE, HOW DID THEY GET A COPY OF THE CONTRACT?
[IMG][/IMG]
[IMG][/IMG]

With some posts earlier stating that the HOA may have trouble breaking the current contract with APS, I was heartened to see that there is no penalty clause, no multi-year contract, just a simple 30-day written notice by either party.
As I stated before, the HOA cancelling the contract, and APS losing this lucrative 700-home development would be one positive outcome of this fiasco.
A1/A2, I wish you all the luck in the world in your effort to involve the media.
And remember, the Vortex has your back!
-Glenn
(oh, and page 44 pwnage!)
