Thread: Total engine failure at 90k miles 6 weeks out of warranty not being covered by Audi!

    How about this for getting royally shafted:

    My CPO 2006 A4 B7 failed last weekend. My Audi dealer advised me that I was out of warranty in middle of March 2012 so I took to an independent who advised that the failure appeared to be related to the intake camshaft. I started my forum research at that point as well and found out about the intake cam issue and the extended warranty.

    I told my independent to stop work immediately and called Audi of America who advised me to have the car taken to the dealer for assessment.

    Independent advised the car engine was largely disassembled. AOA advised to flat bed it to dealer or nothing would be covered. Independent advised at this point that he had spoken with dealer and was recommending a complete cylinder head replacement. He flat bedded the car to the dealer yesterday.

    Under dubious circumstances AOA and the dealer have decided that the extended warranty do not apply and are advising a complete engine replacement at a cost of roughly $12,000.00!

    The car has 90,800 miles, no modifications and has been dealer serviced at every recommended interval. It had the timing belt changed at the dealer within the past few thousand miles. It has had 5k mile oil changes with high quality synthetic oil and has only been run on premium fuel.

    It is simply inconceivable that a complete failure of the engine, likely related to the intake camshaft (a known weak point on these cars) can occur and Audi refuse to stand by its product!

    The worse thing about all of the above though is that the customer service representative who I spoke with would not connect me to a supervisor or the legal department. I was advised only that a supervisor would return my call in one business day and that I can mail inquiries to the legal department.

    All of the above while the dealer is telling me that he is going to charge me to store my car if I do not make an immediate decision regarding the engine!

    This is completely unsatisfactory and I am going to have no choice to commence legal proceedings.

    I just got off the phone with dealer who made further inspection of the car.
    Dealer says that the failure is neither the high pressure fuel pump cam follower or the cam itself.
    He states both are in good condition.
    He states that it appears that the failure occurred at the oil pump chain drive.
    Again a known failure area for these cars and still no one is offering any assistance.

    I just ran a car fax on the car to confirm what dealer is telling me about my warranty expiring.
    The car fax has the car being first registered on April 20, 2006 as a commercial vehicle and listed through September 12, 2006 as "dealer inventory." It was first sold on September 30, 2006.

    My failure occurred on Saturday April 21, 2012 at 11:00am. I have the AAA towing records and emergency call records to prove it even though the car did not find its way to the Audi dealer until April 26, 2012.

    AAA defines "in service date" as 'the date the Vehicle was purchased by the original owner and driven or the date the Vehicle was placed in use for rental, demonstration or other purposes."

    On a worst case scenario, for me that is, my warranty expired at 12:00 am on April 21, 2012.

    Under this circumstance we have Audi leaving a customer left holding the bag on a $12,000 repair for a failure that occurred 11 hours after the warranty expired.

    If Audi takes that position then it would be an extreme case of corporate indifference and it would force me to bring action against them.

    I am a litigation attorney, the issue would come down to whether or not Audi could prove that the dealer was the "original owner" and, if so, that they drove the car on April 20, 2006.

    I have left messages with AOA and the dealer and am hoping they come to their senses.
    If anyone here could offer support I would greatly appreciate it.
