So got a call and the dealer wrecked my car. Finally got the police report and stated that the accidnet happened at 1:20 pm, but the dealer never called me until 4:30 in the afternoon. Finally heard back from their adjuster and get this! They are not going to pay the full amount of the quote of the bodyshop quoted for the repairs.
Till this day, the dealership has NOT offered me anything to compensate me for my time or anything. Afer a week I have no check and still no offer from the dealership to take care of this issue....I have a loaner car from them, but now Im going to get back my wrecked car? IM SO ANGRY!![]()

Not sure if Im going to say at this time.. still getting all the stuff together. Im going to end up prob getting an attorney. The whole front end is going to be replaced. 5k worth of damages. The tech driving my car was distracted and looked up and ran right into a lady at a stop light. He was prob texting....

I understand the need to let off steam and telling other VW enthusiast is a good method cause we can relate to your passion for your car.
However we need a dedicated thread for these.
Maybe a Letting Off Some Steam thread where we can can go and see what crappy has happened today and reply.
A post for each event is unnecessary especially if we can make stuff concise and organized.
(but that really does Suck, Sue the Sh!t out of them)

Thanks.. Who cares about letting of some steam if they don't want to hear me rant go read something else on the Honda pages... In my driveway I have 2 rabbits and 1 Jetta 1 golf.. well minus the one that was wrecked.....Really looking for some advice or anything here. Kinda rare that this happens. That's all. Not looking for FORUM police to have their panties in a bunch.. if you need some I have a a whole drawer full of them.![]()

I was trying to be kind and understanding I had nothing great to contribute for you since this has never happened to myself or anyone i know.
I am not trying to forum police but like organization which the MK5 forums is slowly starting to lose.
Sorry that the dealership whom you should have been able to trust trashed your car but at least i wasn't a jerk about the post. I was trying to be constructive.

Why would they not pay for 100% of the damages to your car? Get your insurance company involved. If you have collision they will take care of you and go after the dealer and/or the driver of your car.

OP sorry to hear, I always seem to get incredibly pissed off by just about every VW Dealer I have ever gone to they act so stupid sometimes. As others have said I would definitely take action on your own part also just in case the dealer tries to screw you over. Call your insurance company and tell them what happened and see if they can move things along for you.

Yes.. GM - General Manager. LOL I thought that was funny that you guys thought I might have taken it to a GM dealership. ::giggle: yeah, no.
If It goes on my insurance, I get dinged. On theirs, its on their terms. I think tomorrow I'm calling the lizard to have someone come out and do an appraisal. This whole thing has been so stressful and so annoying. Customer service has really gone down the tube. Funny how they are so nice when they take your money.. but the other way around they are total arseholes.

Also I feel you on the insurance, no one wants an insurance hit, especially when they weren't even in the car for the accident. And how is the dealership even rationalizing not giving covering the damages, they clearly caused it lol.

All dealerships have General Liability insurance policies with a rider on it called Garage Keepers. In this rider if they have the three "Cs" then they are FULLY responsible for what happens to your car. Meaning if they have the Care, Custody and Control of your car their insurance policy has to take care of any damages.
The problem you will likely face is what guidelines the insurance company they have go by. Some will replace your parts with OEM parts (which will cost more) and MOST will use NON OEM parts. Either way you should not be penalized or pay a single penny.
My advice FIGHT for OEM parts to bring your car where it was prior to them having the "Cs" and also fight for more. Now that your car was involved in an accident your car is no longer worth what it was prior to that accident. You now can ask for compensation for DEPRECIATED value.
I have an insurance agency and I am a state licensed insurance agent. DO NOT SETTLE for anything less. DO NOT allow your insurance company to pay for your damages to your car. JUST BE STERN and FIGHT FOR WHAT IS RIGHT. In a polite manor tho.

When your asking for OEM parts, use the saftey features the OEM parts come with that the NON OEM parts will not come with. For example: Crumple zones on the hood to prevent it from going strait in the cabin.

If OEM parts are requested there should be no questions asked. You pay insurance for your car. Not a Chinese byproduct of it.![]()

If this dealer or their insurer is dragging their feet or giving you the run around get your insurance company involved immediately to get the car fixed. Depending on what direction this shop takes they could start charging storage and if enough time passes put a lien on it. This is a worst case scenario but over the many years that I have handled claims I have seen this happen countless times.
Insurers have every right to put aftermarket or LKQ parts on a car of that age. The purpose of an insurance policy is to indemnify those involved. Putting brand new OEM parts on a 4-6 year old car over indemnifies. Some insurers are more lax than others on this point, but in no way does this "penalize" the parties involved. This is standard practice backed up by the states that allow the insurers to write policies and handle claims. It isn't some trick by the insurance companies to rip people off. You can always push for OEM but don't be surprised if they don't bend and give you everything you think you deserve.
That said...if the dealer does take care of you then you probably have a better chance of them using all OE parts since their cost is likely similar to the cost of aftermarket or LKQ in some cases.
