went to check upcoming fluid change on girlfriends 08 jetta, wanted to verify bolt aka 6262-2 tool fitment, jacked car level tranny at 28c according to VAG, pulled plug and ugly black fluid ran out, only 53,000 miles on it. i would think level would increase due to expansion from heat at 40c recommended checking temp, so there should have been no runout due to cooler temps. her former car an 06 subaru was a half qt overfull also

Your trans might not have been overfull. Note: Being overfull doesn't cause problems other than fluid running out the vent so dont panic. Its a "urban myth" that overfull fluid will damage a trans.

The valve body has "fluid passage exhaust ports" and there are spinning componants in side the trans. This fluid jetting into the fluid in the pan makes waves. The high point of these waves can make fluid come out even when the fluid is low.

Check procedure is to overfill then let drain till fluid coming out is no longer a steady stream. When it first starts "gurgling" then plug it.

Note: Also if I recall correctly then 30C is the correct check temp. I dont have time to look it up to verify right now though.

Auto trans fluid change or flush will not make a trans fail. Stop spreading the wives tale/urban myth.

car is level not running, vag said 28C so it was under spec fill temp of 40C at which it would even be at a higher level!! overfull is said to cause xtra pressure possibly blowing seals!!

The engine needs to be running when you pull the plug to check the fluid level. That way the ATF has been pumped through all the ports, passages, drums, TC etc. If the car wasn't running when you pulled the plug then you're WAY low on fluid now.

Since you were trying to check with the engine off then it looks like this guy may have been right after all.
