Thread: Bought a new 2012 Jetta it was in an accident

    I bought a new Jetta with 41 miles on it. 4 days later they call me cause they need to see the cars vin #. When I take it back to the dealer they tell me that the car had been in an accident during a test drive. They fixed it but they shouldn't have sold it to me as new. I told them well I want a new one. 3 days later they call me and let me know the new jetta was in. I spent another 2 hours at the dealer signing paper work ect. I asked the sales man if they could tint the windows for me he said no. I later called the GM and he doesn't answer his phone or return calls so I spoke to an assistant GM and told her if I can't talk to the GM I'll just write the complaint in the survey Vw sent me. My question is am I asking for to much? Get them to tint the windows? I mean for time I wasted for their mistake.

    Dealers sell cars as new all the time that had some damage during transport - and they are allowed to do so. An accident may be a different matter, depending on how severe. At any rate,

    1. they were pro-active and contacted you,
    2. you got a brand new car.

    I think the dealer acted great and you came out well.

    Sounds to me the dealership went out of their way to do the right thing for you. Why not just take it to a tint shop and have your tint done? Unless the dealer offers window tinting I dont know why you would be asking them

    agreed. they found out they made a mistake and you got a new car out of it. why not just make them take you out for a drink?

    Seriously this. They could've done nothing and you wouldn't know about the accident until trade-in time, if at all. BTW, if that new Jetta isn't good enough for you, I'll be happy to take it off your hands.

    The purpose of me going to a dealer is to buy a new car. Normally it takes 1-1 1/2hrs to get the paper work done I had to go to the dealer three times spent 3-4 hrs because of their mistake. They didn't do any favors. The day I trade in and find they sold me a car that had a previous accident as new that would be a good lawsuit. They were protecting themselves not me. At the end of the day I got what I paid for, a new car. The only problem is that it took me a lot more time and hassle to get.

    Protecting themselves or not, they still contacted you to start with and got you a new car, which is more than a lot of dealers do. I'm actually impressed that they did that without any hassle.

    And did the guy say "No, we can't do it for free" or "No" as in, they don't tint there?

    You got a new car. Yes, it sucks you had to spend some more time there, but they were up front with you once they found out and worked with you. Be happy you had such a good dealer experience.

    Eh, I agree the dealer did the right thing, in at least replacing the damaged vehicle with a new one..

    That should have happened regardless.

    But I am with the OP on this one, in that the sale of the damaged vehicle to the OP without this information disclosed should have never happened in the first place. It was their mistake, at his expense. I went through a similar ordeal, but mine was a lot worse.. And dragged on a lot longer.. And I got nothing for my troubles, nor did I get a new car. So you faired better than I.

    IMO the dealer did the minimal, in getting him what he had already paid for and put the time in for. They didn't do him any favors. They simply corrected a mistake on their end.

    They did not rectify the added hassle and time it cost the OP, nor the unpleasant experience of finding out your "new" car wasn't new, and you have to go through all the hassle of being at the dealership again. I personally absolutely hate being in dealerships, almost as much as hospitals..

    I don't know about window-tint, but a couple of complementary services or a couple gas fill-ups would have been a good gesture for the inconvenience.

    Getting what you paid for to begin with, is not reward for the BS he went through tbh. It's ass covering.

    I would say the OP is lucky that they decided to come clean though. But he was not compensated for the inconvenience.
    And although it is correct that dealerships don't have to disclose damage on a new vehicle if it under a certain amount.. ($10,000 here) lol... I do believe the fact that it was damaged during an accident, rather than a manufacturer or transport incident... changes that. I am not certain of this though, and if it doesn't change things, it really should.

    I would be glad you got what you paid for in the end.. And do your servicing at another dealership. They were unprofessional for letting this incident happen at all. And they are certainly not trying to get into your good graces after the matter.

    No sense adding to your stress, by having to go back and deal with a dealership you don't like working with to begin with. This is unfortunately a good way for dealerships to lose business, because they aren't looking at the bigger picture. Selling one car isn't that impressive, and definately isn't the end of the potential profits to be made.

    Well, lets play the legal angle since you brought it up. This way this unfolded, you would've gotten nothing from your "good lawsuit" since the dealer found the problem and offered a remedy quickly. The dealer made a mistake but acted quickly in good faith. I suspect how the law works in Georgia, acting in good faith and fixing the problem promptly would protect the dealer from any damages.

    I see no wrong in you asking asking for them to sweeten the pot for thier error. I also see no wrong in the dealer telling you they'll pass on providing you more than what they are required.

    I wonder if how you approached the issue with the dealer could be influencing the outcome?

    something like a basic tint job would've been nice

    especially since what they did was sort of illegal, putting a car out on the lot that's been in an accident

    if you got in a crash and the airbags didn't deploy, you'd bet that was a lawsuit

    even if there were no legal statutes, the reputation would be worse than death to the dealership

    how could they botch something so basic ?
