I walked up and asked him what he needed and he said "I ran out of gas and my battery is dead" so i walked to my garage and brought him a battery and handed it to him. He is now gone.

Well no and yes.

If you say he was verbily threating you, then say that he threatend to shoot you and reached down under his seat you could still shoot him in self defence. You would just have to make sure you killed him in one shot he could not tell his side of the story.
