If this dude settled under false pretenses, and this video surfaces, he can be sued for fraud (i think).

That's not to say that negligence isn't the cause of many claims, and is perfectly acceptable... but I believe it has to do with how this was presented to the insurance claims adjuster.

e.g. No I wasn't speeding, an animal was in the road and I swerved to avoid it. I'm not at fault.

That could be grounds for a law suit... i think.
Yes, he could be sued for fraud in that case.

However if he just said "I lost control on a mountain road" even with the video it will make little difference, he's not lying.

Yup, in which case he could be placed on facility (is that a US thing as well?) - and denied regular insurance premiums after the case.

LOL, well traffic can get so bad here I would rather use it anyway, but in the summer I end up biking most places anyway.

I love to drive, but driving in a flat area with heavy traffic and only right and left turns is NO fun.

      summer transport!

I am not 100% sure, but i dont think thats a US thing.

This would probably just be considered an at fault accident and his rates will be raised accordingly.

My life would be so much more awesome if I traded in the Speed3 on an E46 M3, moved to California, and spiked my hair.

I would venture to say that some law was broken in nearly 100% of accidents. When I was in college, I spun my car in a snow storm and hit a tree. I received a ticket for "Driving outside of marked lanes." That tree was most definitely not in the travel lane, so I did in fact break the law. Should my insurance claim have been denied? Insurance would literally be useless if this was how they operated.

Even then I don't think it would matter. I don't think the insurance company really bothers classifying single vehicle accidents. Regardless of the reason you ran off the road, it's ALWAYS* your fault. Swerving around an animal? Shouldn't have swerved. Lost control in the snow? Should have gone slower. Driving like a tool bag on a mountain road? Shouldn't be a tool bag.

All this talk about fraud Insurance covers 'stupid' - why do you think we pay so much in premium? Regardless of circumstance it was an accident - kid didnt intend to drive off cliff. I cannot believe he put the footage on the internet though... Dumbass.

Oh and all this talk about "expensive car" It was a 10 year old 3 series when he bought it. Maybe 14-16K - I know a lot of low rent people paying twice that for new KIA's and Hondas

This. I work in the Insurance Industry and most policies if not all unless they are a specific HPDE policy will exclude racing, practising for racing or any timed events. This video may constitute "timing" and therefore would be excluding coverage. If this claim was paid I'm sure the adjuster didn't know about the video because if they did. Deny Deny Deny. So that puts this into the Insurance Fraud world and now this kid has really gotten himself into another level of trouble. In the end if he's caught he'll be forced to return the money or a judge will put a lien on his paycheck until he pays it back

literally could not have laughed harder at this thread when I got into pages 5-7.. video was wild, he's an idiot, and drives like he's filming fast and the furious, I would say barely in control through most of the video.. until he decides to tuck and roll over zee cliff. much deserved totaled car, deserves the highest rates possible, and luckily only some minor injuries it looks like.

      but hey...

cant help it if you're just born to drive what a moron

yeah agreed! Half of the people here would probably chicken out on buying an old M3 over a new economy car because of "expensive maintenance" or something anyway.

Granted, this guy needs to learn how to drive, and I don't feel like insurance should have to cover that particular accident.

The TCL detectives never cease to amaze me.

The guy, I hope, will learn his lesson. Obviously, he didn't by instantly uploading his BroPro footage, but maybe some legal action or ridiculous fines will remind him to not live outside his means again.
