TL;DR
Dealer had an approved loan on 7/3 I took delivery 7/4. Dealer asked me to come back on 7/17 to sign more stuff and I did. Dealer calls again 7/31 to come back and sign more stuff. Credit union hasn't funded the loan, waiting on dealer. Can I give the car back?
Long version.
So I went and bought a used (CPO) car on July 3. I worked out the sales price got everything handled with the finance guy. I walked in with my own financing from my own credit union but he insisted on running his loan program to see if he could beat my rate which he did. I was fine with this so I went with his deal. I pick up the car on July 4 and start using it as normal.
I get a frantic call on July 17 telling me to come back in and I have to sign more paperwork. I expressed that I'm not happy about having to make another trip to the dealership but I've already been there three times wants to purchase, once to pick up, and once to have the certified check list ran over on the car in order to make it a certified preowned, because they were not able to do this on the day that I picked it up. I told the finance guy I've been there too many times for what should've been one trip. I make my way over there in the following days and sign his paperwork and I think everything is all set.
Fast forward to July 31 I get another semi frantic call stating I have to come back in and re-sign and also bring any paperwork that I have that's already signed. I'm very inconvenienced by this whole thing and I don't have time to be going back-and-forth to a dealer that's not in my town to correct their mistake. I called the credit union where the loan was placed and they told me it is not yet funded they are waiting on additional documentation from the dealership. At this point I feel that I am over it and I don't owe them anything else other than what I've already put into it and I'm very very tempted to drop the car back off at the dealer and tell them they can have it. I have no money tied up since I didn't put any out-of-pocket it's all in the loan. The loan has yet to fund so I'm not the owner.
They've created an extended opportunity for me to think about this and I've decided I don't want it. I've had issues at this dealer before with the service department but I wanted to give them another chance since I knew someone that worked there, who is not involved in this transaction by the way.
I'm thinking they don't have this thing funded, they are missing a sale in July and they know they are at risk of losing the deal. I've bought close to a dozen cars at dealers and never had this issue.
So my question, can I take the car back and stop this nonsense?
