What exactly are you being charged with? Just curious, and if you need some legal advice, my uncle works for John Ashcroft, and if you'd like to message me, or email me (wildabeast56@hotmail.com) with any questions, I will forward them to him. I sympathise with your situation, and i'm sure that if it's any reasurance, Jim Ellis won't be selling the D1 sedan, i'm told that it will be distributed very selectively to dealers, based on many factors, and will have it's own showroom, etc etc, very exclusive deal, they're actually trying to set a "new standard" for luxury, beating out lexus and mercedes and BMW, even in service, they're shooting high, being a lexus owner, this is something i'm going to have to see to believe. Good luck in your endevours, if you need any help, i'm sure many have offered, but add my name to the list

Just checking in from korea again. I have spread the word over here as well. We are all with you. Jim Ellis, here is a name I won't forget, once I get back to the states and shop for a new car, I will have to research the dealership as well as the car I might be buying. Wow. You can be sure my Corvette won't ever see Jim Ellis Chevrolet again. Quite glad you won, but they shouldn't have ever sued in the first place. What slimy lawyer would even take a libel case where there clearly was no lying involved?

i'm from http://www.rangerforum.com and just wanted to say congrats on winning your case, but you won long before that because after reading the first page of this thread, i will never go to jim Ellis to buy a car, much less get one serviced and that was the point, right. I've never been to a service dept. that i've liked, but ford and chevy is all i've been to. Atleast they will think twice about sueing a customer in the future. God bless the internet.

Everyone: I can confirm that today, JE contacted my attorney stating their desire to settle this matter amicably. I can't discuss any details, as they remain to be ironed-out at a meeting in the near future. But so far, so good

Keep in mind, though, that this isn't over yet. Which means, first of all, that there may be a ways to go yet... time will tell.

Second, some of you have raised a good point. While we can't assume my experiences to be typical of the VW ownership experience, we should realize that VWoA needs better control over its dealers. Their rather laissez-faire stance on these events is disappointing at best, and they need to be held accountable, to reduce the chances of other "rogue" dealerships treating their customers similarly. Therefore, keep the pressure on VWoA to take a greater interest in the dealings and attitudes of each and every part of their dealership network. Let's use the power we harnessed here - the unity of auto enthusiats everwhere, facilitated by the Internet - to make VWoA (and other manufacturers!) a truly world-class company in terms of customer support and service.

Third, some of you have recorded some of the particulars of the events here, e.g., the long list of other auto-enthusiast web sites showing their support. Please keep up the good work with the documentation Who knows, this may become a VWvortex news story so let's keep the facts straight should that happen.

Fourth, contributing the funds you've donated to me, to the EFF, is a good idea. I will of course entertain any other ideas you may have. It might be a while yet before this is all over, and thus a while before the funds become available for such a worthy cause. This gives us all some time to ponder the best use of this money.

Finally, as always, thank you all very much for your support - your unity, your standing with me to defend consumer rights, your words of strength and wisdom, and of course, your donations. For a while there, it looked bleak; it looked as if I would have to cave in, due to otherwise insurmountable legal costs We couldn't have made it this far were it not for all of you.

It's late, I'm tired, and need to spend some time with my friends and family. So I'll say again, Happy Thanksgiving everyone I think we can all breathe a little easier and really enjoy our turkey tomorrow, and be thankful for what we accomplished here in the last few weeks.

Wow...what a superb response to all of this. It is too bad that it shows how much ignorance is flying around in this e-world. What is so sad is that Mr. Mantis and all the other disgruntle VW owners are writing this info from their viewpoint, and we all assume it is completely correct down to every period. (As it could be) We do not hear the other side, however, of the Service Rep, Manager, or other Person with what they see and hear. Did you have the courage and maturity to speak with these people with a 'Great Attitude' as well, or is this a desperate attempt for self survival. I am not giving rights to dealerships or any other shop to degrade you or give you bad service. I do believe we have all had bad experiences. I went to Taco Bell one time, and dammit, they gave me a soft taco instead of a Hard Shell taco...Boycott them, come on, all of ya, lets boycott Taco Bell.. I got a Freakin Soft Shell Taco, and I wanted a Hard Shell!! Uh...dont think so...I bet a lot of you guys or gals in Chat Room world are pissed off that your Warranties have been voided because you added speed shifters, or oversize wheels and tires, or Air Intakes and exhausts, or maybe even a Turbo Charger here and there.. This is the world of internet I suppose. Ignorance is bliss, and it seems that there is a lot of bliss is out there. Come On...accept responsibilty for your own actions people.. Quit blaming others for all of your own inadequacies. Tell you what, lets shut down every buisness when they piss us off. Before you know it we will not be able to buy a car from the Manufacturer even. I mean give me a break, do you really think Jim Ellis would exist for 40+ years treating people like crap. Not no, but HELL NO. I guess I am peeved at you crybabies. I bet the reason there are not more people writing positive things in these stupid chat rooms is because they have better things to do with their lives... (I am obviously in a rut right now...) I have bought cars from Jim Ellis, had them regularly serviced by them and believe they have done an Excellent job. Sure, some misunderstandings at times, but they got resolved with the right attitude and communication..

Well, I know there are going lots of you guys and gals reacting to this...but if for one second you use your Brain, and analyze this, it was all worth it, no matter how many of you hate it or me.

[edit] That "amen, brother!" above was directed at g-man's statements, and not those of "WhatRUsmokin". First of all, I think this case can in no way be compared to your soft taco debacle. If anyone here has "inadequacies", I believe it is you. Buy another 39 cent taco.

I think you are right about us being concerned about warranty issues and the like. The dealership should not be Judge, Jury, and Executioner when it comes to voiding warranties. I am behind g-man because I know what poor service can be like, and finally we are all fed up enough to speak out about it (following g-man's lead). Contrary to your views, I believe we, the people with dealership and service problems are all-too often the ones with too little time to respond to dealership horror stories. We constantly ignore them, which leads to the shameful service exhibited by way too many Volkswagen (and other) dealerships. [/edit]

I honestly think that you're a whiner, but I am opposed to the lawsuit fo the simple fact that I am opposed to frivolous lawsuits. I believe that this situation could have been settled in a more amicable manner, and to the satisfaction of all parties without requiring mediation in a court of law.

Incredible result of the new media! I hope the final chapter is as good as it portends. You should know for sure on Monday... and I truly hope they go overboard in trying to make amends instead of simply dropping the suit and thinking that that's all they need to do.

Umm, a business filed a lawsuit against a customer. If you cannot see the absurdity in that, then you DO need to take another hit from the crack pipe!

I linked to this post off of RAMVA & spent about the last 3 or more hrs reading all 22 pages of it. Let me just say that it IS discouraging (although not exactly uncommon) to hear about a story like yours (poor service).Of course sueing you is unheard of !
Personally I feel that VW has really been trying to improve their level of customer support over the last 3 or 4 years. Sometimes getting those follow up "after service calls" can be annoying but I always participate, thinking that they are really trying to improve but then you read some of the horror stories posted on the net and it makes you wonder what the hell some of the dealerships are thinking. I have noticed that a lot of the posters stated that they would now never buy a VW, but I've got to say that it REALLY depends on the dealer in question and if this is the way this dealer treates his VW customers then I am sure he treats the customers at his other dealerships the same. Personally I have always been satisfied with my dealer, VW of Fort Myers. I never had to make an appointment for an oil change, I just showed up & it was always done on the spot. They don't wash my car but they do vacuum it. I've had to have it in for service 3 times. The first time was a flat tire(3 inch construction spike) , I went to change the flat tire only to discover I was missing the security-bolt adapter. They towed it in for free & changed the tire which wasnt covered under warranty.They did order the bolt adapter for free. The next time my gas flap wouldnt open so I drove it in & they fixed it in about an hour under warranty. Then a year later my ignition switch died. Free tow & fixed in a couple hrs.
So all in all I am satisfied with VW & their level of service. Also from reading your earlier posts it sounds like you found a really good dealer who took the time to keep you happy which is what it's all about. I am glad to see you and your girlfriend aren't completely turned off to VW's by this whole experience. Stick w/ DH because in the end these will be the companies who succeed and the dealers who don't care about their customers will eventually go under.

greetings from an australian http://www.supercars.net tech forum member....... i'm a mechanical engineer completing (for fun) a commerce (management / marketing major) degree: a paper i wrote was in fact based about the resurcenge of vw in the us.

.....congratulations gman on what has been achieved. the secondary effects are saddening on both sides but your point is extremely valid especially in the context of "car people". the point is not to take the wind out of the dealership or a name but to ensure this doesn't happen again. the dealership in question just could've taken the criticism on board and done something constructive about it. it's been done before in the face of such adversity in the auto industry and the goodwill it generates (lexus dealership anyone ?) spreads about as quickly and universally as the poop these guys have got themselves into. taking your own customer base to court is beyond illogical.
